1. Information Collection and Use

We collect information from various sources, as described below, to provide our Services to you, to analyze and improve our Services, and to communicate with you (e.g., to send you updates or notices about HLS, or emails about products or services that we believe may be of interest to you). We also collect information to comply with applicable laws.

Information that you provide to us: We collect information that you provide to us when you complete any online forms, use our Services, or communicate with us. For example, if you complete an online form, then we may request your personal information (e.g., name, postal address, email address, telephone number) or as applicable your business information, to perform the Services, to send you information about our lending partners or partner services, to send you promotional offers from third parties that we think may be of interest to you, or to otherwise provide our Services to you. Similarly, if you request information from us through an online contact form (or if you email us), we collect the information you provide (e.g., name, telephone number, email address) so that we can respond to you.

Information collected through technology: When you use the Services, we may collect certain information about you or your computer or device through technology such as cookies, web beacons, or other tracking/recording tools. HLS uses Eloqua, a third party, to assist it with marketing and customer relationship management using, among other things, information collected over the HLS website. Information and cookies collected through the HLS website may be used by Eloqua in accordance with Eloqua’s Privacy Policy, located at: www.eloqua.com/about/privacy/.

Information HLS and Eloqua may collect is itemized below by the technology used to collect the information, and may include, but is not limited to, IP addresses, referring URLs, access times, browser types, device types, mobile device identifiers, geolocation/GPS coordinates, or information about your interactions with our website, applications or services. (Note that a "cookie" is a text file placed on a computer’s hard drive or stored on a mobile device; a "web beacon," also known as an Internet tag, pixel tag or clear GIF, is used to transmit information back to a web server.). We collect and use this information to, among other things, (i) operate our Services, including by remembering information so that you will not have to re-enter it during your visit or the next time you sign in to your account, (ii) identify and protect our customers, (iii) control unauthorized use or abuse of our Services, (iv) provide custom, personalized content and information, which could include advertising, (v) monitor aggregate traffic patterns on our website and services, and (vi) analyze and improve our Services.

Website Analytics: HLS and Eloqua may automatically track certain information about you based upon your behavior on the HLS website. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand and serve our users. For instance, we may use a web analytics tool to analyze website usage, how our users arrive at the HLS website, what they do on the website, what browser they are using and on what operating system, etc. However, this analytics data, collected via a JavaScript tag in the pages of the HLS website, is anonymous (i.e., not tied to personally identifiable information about you).

Cookies: HLS and Eloqua may use cookies on the HLS website so we can recognize a return visitor as a specific user. The cookies are readable only, and cookies cannot access, read or modify any other data on a computer. All web-browsers offer the option to refuse any cookie. If a visitor refuses the cookie, HLS and/or Eloqua does not gather any information on that visitor, but doing so will require you to re-enter certain information at each visit, or prevent us from customizing the site’s features according to your preferences. You may also delete a cookie manually from your hard drive. Cookies themselves do not contain any personal information. We do, however, link the information we store in cookies to any personally identifiable information you submit while on the HLS website.

This information is used for the operation of the Services, to maintain quality of the Services, and to provide general statistics regarding use of the HLS website. If you choose to not have your browser accept cookies, you will be able to view the majority of our site.

Web beacons: The HLS website contains electronic images known as web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.

Social buttons: Social buttons enable users to share or bookmark the web page, including buttons for: Twitter, Facebook, LinkedIn, and YouTube. In order to implement these buttons, and connect them to the relevant social networks and external sites, there are scripts from domains outside of the HLS website. You should be aware that these sites are likely to be collecting information about what you are doing all around the internet, including on HLS’s website. So if you click on any of these buttons, these sites will be registering that action and may use that information. In some cases these websites will be registering the fact that you are visiting the HLS website, and the specific pages you are on, even if you don’t click on the button if you are logged into their services, like Google and Facebook. You should read the respective policies of each of these websites to see how exactly they use your information and to find out how to opt out, or delete, such information.

External web services: We use a number of external web services on the HLS website, mostly to display content within our web pages. For example, to display images we may use Flickr; to display slideshows we may SlideShare; to show videos we may use YouTube. This is not an exhaustive or complete list of the external web services we use, or might use in the future, when embedding content, but these are the most common. As with the social buttons we cannot prevent these external sites, or external domains, from collecting information on your usage of this embedded content. If you are not logged in to these external services then they will not know who you are, but are likely to gather anonymous usage information e.g. number of views, plays, loads etc.

Email tracking: Some emails that we send you have no tracking in at all e.g. service emails. Other emails we send we put in tracking so that we can tell how much traffic those emails send to the HLS website, but we do not know who has clicked so the data is anonymous.

HLS’s Services are intended for use strictly by adults. HLS does not knowingly solicit or collect personal information from children under the age of 13. If HLS becomes aware that it has collected personal information from a child under 13 in retrievable form in its files, HLS will delete that information.

HLS maintains reasonable administrative, technical and physical safeguards to protect the confidentiality of information transmitted online, including but not limited to encryption, firewalls and SSL (Secure Sockets Layer). HLS has implemented policies and practices pursuant to various security rules and regulations relating to the security and safeguarding of payment cardholder data, including the Payment Card Industry Data Security Standards (PCI-DSS). HLS is not liable for loss of passwords due to user negligence. If you believe your password has been lost or compromised, we recommend that you immediately change your password.

We may store and process information in the United States or any other country in which Heartland Payment Systems, Inc. or Encore Capital Finance, LLC or their parents, subsidiaries, affiliates or service providers maintain facilities. HLS may transfer information that we collect about you, including personal information, to parents, subsidiaries, affiliates, or service providers across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
